Difference between criminal law and civil law
In civil law, a private party (eg., individual person) files the lawsuit and becomes the plaintiff. In criminal law, the litigation is always filed by the government (Crown), who is called the prosecution.
In criminal law, a guilty defendant is punished by either incarceration in a gaolor prison, or a fine paid to the government, and all any other sentences. Crimes are divided into two broad cases: felonies, which have a maximum possible sentence or more than one year incarceration, and misdemeanors, which have a maximum sentence of less than one year incarceration.
In civil law a defendant is never incarcerated. In general a losing defendant in civil litigation only reimburses the plaintiff for losses caused by the defendant’s behaviour.
